The 86 deputies who participated in the session virtually voted for the loss of their mandate. It was articulated as a way out of the pressure from civil society, made in the last few weeks, asking for Cury’s impeachment. The debates on the punishment of the parliamentarian were resumed this afternoon, after the morning session be suspended, at the request of the President of the House, Carlão Pignatari (PSDB), so that the topic could be discussed by the college of leaders of Alesp.
“We leave a message for society: Alesp will not accept harassment, we women will not accept harassment, be it moral, sexual or psychological! We will be side by side with all women”, said Isa Penna after the final result. She highlighted the fact that they increased the suspension from 119 days to 180 with the support of pressure from civil society, although she always defended the impeachment. “It is a gap that opens up in Brazilian political history and against gender violence. And to see that this House is changing from my cry and my silence,” he told the Estadão.
Through a note, deputy Fernando Cury said that he receives “with serenity and respectfully the decision of the plenary session of the Legislative Assembly of São Paulo, determined by fellow deputies”. Next week, the alternate, Deputy Padre Lobato (PV), will be called.
After the vote this Thursday, the President of the House, Carlos Pignatari, called on colleagues to change the internal rules of the Assembly to speed up the process in future cases. “We are going to make the rules and punishments clearer, so that we do not have more discussions. It is not possible that a process as sad as this one took so long. We have to speed up. I hope that we will never have an act like the one we had in end of last year, “said Pignatari.
A large part of the deputies who spoke at this Thursday’s session considered that the increase in the suspension to 180 days was the result of dialogue and articulation in the last two days. “Yesterday’s session started hard, without showing any possibility of understanding. But as soon as the leaders moved and society took a stand, it became possible to have a greater penalty than the proposal”, said Emidio de Souza (PT). He was the rapporteur of the case at the Council of Ethics and Parliamentary Decorum, when he had already proposed the six months suspension. Nonetheless, was won by 5 to 4 by the opinion of deputy Wellington Moura (Republicans), who drafted the opinion for the suspension of 119 days.
Isa Penna’s defense was favorable to the termination of Cury’s mandate. The deputy, however, acknowledged that the penalty would not be supported by the majority of parliamentarians. For this reason, according to Isa, the approval of Cury’s six-month absence would already mean a “timid” advance in the case.
“We have been debating for 12 hours the possibility of giving a more fragile sentence than the penal code itself gives for the crime for which Fernando Cury committed.”, Said deputy Isa Penna at the beginning of her speech during the long session.
She also stressed that during the process she reported “strictly what she could prove because she knew that a delegitimization project would come”. However, in the final conclusions, the tone was one of partial victory. “That [suspensão] it is a victory for feminism and that you will not be able to take away “.
At another point in the session, shortly after, Congresswoman Marina Helou also reported a harassment she suffered on her first day in office, in 2019.
This Thursday’s session was a continuation of the discussions that started on Wednesday, the 31st. The postponement of the decision on the Cury case, which Pignatari wanted to end yesterday, can be considered as the first defeat of the new president of Alesp. Asked several times about the possibility of submitting substitute amendments, the president remained adamant when denying each “question of order” presented by deputies throughout the day. He stated that a legal opinion from Alesp did not provide for the possibility of submitting amendments. The change took place in the late afternoon through the disposition of opposition deputies and the situation in remaining obstructing the voting process.
In addition to Barros Munhoz (PSDB), Carlos Giannazi (PSOL) and Campos Machado (Avante), they started to defend the inclusion of amendments to deputy Janaína Paschoal (PSL), who even asked for the impeachment of Cury, Gil Diniz and several representatives of the PT, in addition to Isa Penna herself.
The impasse was resolved after the President of the Assembly called a meeting of leaders on Thursday. “This house of laws, with legal certainty, trusts the smoothness of the procedure established in relation to the Draft Resolution, but seeks a political way out, because this is, above all, the essence of this parliament”, he said.
